Introduction

This mymart.com website (the “Site”) is owned and operated by Carbon Music Ltd, incorporated in England and Wales under registration number 5816625 and with registered offices at Ground Floor, Block 3, 6 Erskine Road, London NW3 3AJ (referred to as “we”, “our” or “us” in this Privacy Policy).

The Site is based in the United Kingdom and we comply with the standards set out in the UK Data Protection Act 1998. By browsing and using this Site you agree that we may collect and use information relating to you in accordance with this Privacy Policy. If you do not agree to our use of your Personal Data (as defined below) in accordance with this Privacy Policy, you must not use the Site. Please note that you may edit the Personal Data that you provide, and you should ensure that the Personal Data that you provide to us is kept up-to-date and accurate at all times.

We reserve the right to amend this Privacy Policy from time to time and may do so without further notification, although where possible we will advise you by email or by text message. Your continued use of the Site will be taken as your acceptance of the updated Privacy Policy. We therefore suggest that you review this Privacy Policy regularly when you visit this Site.

1. Collection and use of your personal data

1.1 We will collect information from you which will identify you personally. This will include amongst other things your name, address, telephone number and email address. This information (“Personal Data”) will be provided by you when you browse or use the Site, including completing the registration form on the Site, or by sending emails or other communications when using the Site. Please do not send your Personal Data to us if you do not wish us to collect it. We may require some additional financial information including your credit card details, and we may also use this to help verify the other Personal Data that you supply. For security reasons, your credit and debit card details are provided directly to our nominated partners who deal with electronic and cashless payments, and except for the purposes described in this clause 1.1, these details are not retained by us. You agree to ensure that all Personal Data that you provide is accurate and that it shall be kept updated before you transact with us or with any other person using the Site.

1.2 You agree that we may obtain, hold, use and distribute the Personal Data that you provide for the following purposes (the “Purposes”):

1.2.1 Processing. This will include (but will not be limited to) completing the registration form, registering with the Site, sending communications (whether in electronic or any other format) to or via the Site and any and all communications made by you or by us in connection with any bid or transaction. Any such communications may themselves be retained by us and these will be treated in accordance with the terms of this Privacy Policy and all applicable laws;
1.2.2 Storing and processing information to better understand your needs and interests and improve our products and services;

1.2.3 Advising you of changes to the Site, the services, the terms and conditions or the applicable policies, or in the event that we need to contact you in connection with any transaction made via the Site, any contract that we may have with you or in connection with the services provided on the Site;

1.2.4 Passing Personal Data or other information to other companies within our group of companies including selected third parties, in accordance with paragraph 2 below, where you have indicated to us (either in registering with the Site or in a subsequent communication to us) that you are happy for us to do so. This will allow us, our group companies and selected third parties to contact you for the purposes of marketing such offers, products, competitions or other services which might be of interest to you;

1.2.5 Disclosing such Personal Data or communications as may be required by law, regulation or other lawful request from a government or regulatory body, or as may be necessary to operate our systems properly or to protect ourselves or other users of the Site or the services; and

1.2.6 For accounting, financial and auditing purposes, which shall include the disclosure of your Personal Data to our advisers and our nominated partners who handle electronic and cashless payment systems.

2. Eligibility

Use of this Site and of our services is not available to persons under sixteen (16) years of age. Anyone under sixteen years of age must not register with or use the Site or the services.

3. Sharing your personal data

3.1 We shall share your Personal Data with other companies within our group of companies and selected third parties if you have indicated to us that you are happy for us to do so. Otherwise, we will not share your Personal Data without your consent unless it is necessary for us to share or disclose it for any of the Purposes.

3.2 We may provide others, at our discretion, certain aggregate statistical data about purchases and the use of our content on the Site. This may include information gathered in accordance with paragraph 4 below, and could include demographic data (such as the age-range of groups of users), traffic data (including time and duration of any use of the Site or the services), and location data (including the geographic location of groups of users). Personal Data will not be identifiable from such aggregate data. Where it appears that any Personal Data shall become identifiable from such statistics, then the Personal Data will be treated in accordance with the principles of the Data Protection Act 1998.
3.3 We may transfer, sell or assign any of the Personal Data that we hold to third parties as the result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganisation or liquidation of Carbon Music Ltd.

4. Cookies

4.1 In addition to asking you to submit Personal Data, we may collect information about you automatically when you visit the Site. 4.2 We may collect this information through the use of cookies or other tracking devices. It may be necessary for us to maintain our records for a number of years. However, when information is no longer required, we will destroy records containing Personal Data securely.

The Site may contain links to other websites. We are not responsible for the privacy practice of other websites. When you leave the Site and go to another website that collects information about you, you should read and familiarise yourself with the Privacy Policy of that website. This Privacy Policy relates only to information collected by us through your registration with, and use of, the Site.

8. Control of your password and username

When you first visit the Site regardless of whether you do so using your computer or another communications device including your mobile, you must choose a username and a password. Once you have chosen your username, this cannot be changed afterwards. However, your password may be amended at any time. When you register with the Site, we will also require a phone number from you, and we will verify this information that you supply.

You will be responsible for all actions and transactions made using your username and your password. You are therefore responsible for your username and password, and must take every care not to divulge or disclose either of them to anyone else. You agree not to permit any other person to use your username and password, and will not transfer or sell it to any other person. You also agree only to utilise the Site and the services provided via the Site using your own username and password, and shall not use the username and password of anyone else.

9.2 To view or modify the personal information that we on you, you can access the edit profile page from your account on the Site. You have the right to ask to review the personal information that we hold on you, and to ask us to correct or delete any of this information. Please note that if you require us to send you copies of Personal Data that we hold on you then we are entitled to charge a fee of £10 for the administration costs involved in doing so.
